I think this HORRIBLE SITUATION shows just how our legal system is OUT OF WHACK with good sense and reality.
I hope that this situation can be resolved in such a way that this woman and her child can be protected from this MONSTER.
There is no end of evil that the psychopathic entitled mind can come up with and I think this is at the TOP OF THE LIST.
The solution here is simple. this man needs to be registered as a sex offender and a pedophile. He needs to wear an ankle bracelet and be prevented from having any contact with minors. Including his own children.
I spent the better part of last night angry about this case. I also had the feeling of complete hopelessness. This case really disturbs me because if the court is even considering giving this man rights to this little girl…there is no hope for any of us trying to fight these people in Family Court.
My ex also sexually assaulted someone. In that case, however, it was similar in that the justice system just let him walk about it seemed too hard to prove. He said it was consensual and since he didn’t jump out of a bush and rape someone he didn’t know…he walked.
I am sick of this crap! This man should be in jail. Period. 16 years of probation? WTH?!?! What about the teen he raped? The courts basically said to her, “oh well…you shouldn’t have been around this rapist to allow yourself to be raped and become pregnant.”
I don’t know what else to say but that I am ashamed of our justice system. Just down right ashamed…
Amazing…..Lawyers will take any case for the money…
At any rate: My view:
Number One: The rapist has no rights. He violated her rights so he has none. He lost “rights” when he committed a crime..
Number Two: She became an “unwilling sperm recipient” therefore never agreed to the sperm donation therefore sperm donor has no rights.
Number Three: Rapist can rape again and rape child. Therefore no rights to victim.
Number Four: He is a sperm donor through violence therefore cannot be considered to be a contact for his biological child.
Number Five: So IF Richard Ramirez had raped one of the women before he killed her friend, he could have had rights to the child if she became pregnant and produce an offspring? No court would have granted him “rights”…..(Look up case if you don’t know who he is)……..will leave you cold…
Number Six: No court will give this rapist any rights. We have too many organizations out there. It will never happen….
NOVA….National Organization for Victim Assistance—http://www.try-nova.org/
RAINN…Rape, Abuse, Incest National Network…..http://www.rainn.org/
To name two and there are Many more….But we need to not let this happen….We need to write letters and get involved ourselves….I will be writing one…
And by the way, child support is the way he helps pay for his crime. It doesn’t constitute or support a “right” to have access to his offspring…….anymore then robbing a home would give the criminal the right to visit the home. Absurd….It is part of his payback for his crime.
When one pays for their crimes, that is it. They pay…AND there is no payback for them…..RIGHT?
is shooting to kill to protect a child still considered self defense?
Yep, a THREAT TO LIFE or IMMEDIATE SAFETY of yourself or another is a reasonable cause to shoot someone.
Protecting PROPERTY is usually NOT a legitimate reason to shoot someone.
There are the “make my day” laws in some states though about what constitutes a THREAT so it varies from state to state.
A joke in my area is that “he just needed killin’ is a valid defense”—of course that is just a JOKE but you know, there are times that some folks DO “just need killin'”
I read somewhere in a book about psychopaths that the Inuit people would push someone off the ice who was a psychopath. Actually in some cultures that happens…but in the end, I think the RULE OF LAW is generally better than each man taking “justice” into his own hands, or groups of men taking “justice” into their own hands.
It is difficult to deal with psychopaths for sure…and they do not respect rules or laws, or the rights of anyone. None-the-less, I think that least we become LIKE THEM…we must adhere to the rules of society and the laws of society.
I will protect myself within the limits of the LAW.
Oxy,
EXACTLY. If we become like them, they win. It’s what they REALLY wanted in the first place. All the theatrics are just maneuvers to make us act like them, feel like them, be like them.
That’s what I like about my favorite band’s (Rush) new album, “Clockwork Angels”. It is all about spaths and there is a song about NC. It’s called, “Wish them well”.
Wishing them well as we turn away from them, is so important because that is what keeps us from becoming like them. That’s when we win for keeps.
as the victim of two spaths from 1977-1994, many things now known then were not.
i absolutely agree that evil seeks to also make us evil, which is it’s final “win”.
but to kill to protect a child is not, in my own upbringing/collective unconscious-evil. quite the opposite.
& i’m quite clear that i would, regardless of the law. but to clarify- if that child were in immediate physical danger.
With regard to physical violence against a spath, I want to make something perfectly clear from personal experience: regardless of the situation, the spath typically wins the legal argument.
In my case, I had an emotional breakdown that resulted in a physical attack against the exspath. The exspath did not make a single effort to push me away, get past me, stop me, or even defend himself. He simply stared at me without any demonstration of emotion – no fear, no anger, not one recognizable reaction. He was CALCULATING how my meltdown would best benefit him. The marriage was already over, but he had been going through the motions of pretending that he was “working to save” the marriage.
Oh, no…..taking personal action against a spath will result in catastrophe. Legal, criminal, financial, and emotional catastrophe.
Oddly enough, after the exspath left, the thought occurred to me that he could have easily poisoned me over a period of time, and nobody would have been the wiser. I mean, I was taking serious medications for my condition, and it wouldn’t have taken much to spike drink or food, and then claim that I was either distraught and ended my own life, OR that I had simply died as a result of my progressive illness. Given how detached he was during my outburst, I have no doubt that he had been trying to figure out how to end the marriage without losing everything that he coveted.
Brightest blessings
